In a stunning setback for the Trump administration, a Biden-appointed judge has blocked plans to end protections for 350,000 Haitians living in the United States—just hours before the program’s scheduled expiration.
Judge Ana Reyes, nominated by President Biden, issued an 83-page ruling that reads less like a legal decision and more like a lecture on immigration policy. She began her opinion by quoting George Washington on welcoming immigrants and spent the remainder of the ruling criticizing the Trump administration’s approach.
Trump had designated Homeland Security Secretary Kristi Noem to review and terminate Temporary Protected Status (TPS) for Haitians, a designation originally granted after the 2010 earthquake in Haiti. Despite being labeled “temporary,” the program had been extended repeatedly over the past 15 years.
In November, Noem announced TPS for Haitians would end on February 3, arguing that the program’s continuation no longer served America’s national interest. “Temporary means temporary,” she stressed at the time.
