A Logjam Years in the Making

It’s no secret: President Trump has been at war with Senate delays since the early days of his administration. But the backlog has reached new heights. At least 150 Trump nominees remain in limbo, including key judicial figures and prominent appointments like Alina Habba, currently serving as acting U.S. attorney for the District of New Jersey.

This week, Senate Republicans fast-tracked several low-level confirmations that would typically pass with little resistance. Still, the scale of the stall is staggering—and Trump is making it clear who he blames.

In a fiery Truth Social post, Trump singled out Judiciary Committee Chairman Chuck Grassley (R-IA), warning that the so-called “blue slip” rule is killing his ability to staff key legal positions.

“Chuck Grassley, who I got re-elected to the U.S. Senate when he was down, by a lot, in the Great State of Iowa, could solve the ‘Blue Slip’ problem we are having with respect to the appointment of Highly Qualified Judges and U.S. Attorneys, with a mere flick of the pen,” Trump posted.

Trump: ‘The Only Way To Beat This Hoax’

Trump went even further, blasting an antiquated Senate tradition that allows individual senators to block judicial nominees from their home states.

“Put simply, the President of the United States will never be permitted to appoint the person of his choice because of an ancient, and probably Unconstitutional, ‘CUSTOM,’ that if you have, even one person in the opposite Party serving in the U.S. Senate, he/she must give consent, thereby completely stopping the opposite Party’s Nomination,” Trump wrote.

He added that under such restrictions, he’d be unable to appoint effective legal minds in “California, New York, New Jersey, Illinois, Virginia”—places that, he noted, suffer from rampant crime and government corruption.

“The only way to beat this Hoax is to appoint a Democrat or, a weak and ineffective Republican,” Trump continued.

Pressure Mounts on Senate GOP

Trump isn’t letting his own party off the hook. In the same post, he challenged Grassley to follow the example set by Senate Democrats during the Biden years, when similar customs were brushed aside to push through partisan picks.

“Therefore, I would never be able to appoint Great Judges or U.S. Attorneys… where fantastic people are most needed!” he declared.

At the time of Trump’s post, the Senate had confirmed just one Article III judge—a glacial pace compared to the 26 judicial confirmations President Barack Obama saw at the same point in his first term. Since then, the pace has accelerated, with hearings scheduled and several confirmations moving forward.

One recent win for Trump: the confirmation of Emil Bove, a former attorney for the President, to a federal appeals court bench.

Final Showdown or Just the Start?

With the Senate floor now in session and pressure coming from both the White House and grassroots conservatives, the next few days could determine how much of Trump’s legal agenda moves before the November election season dominates the airwaves.

One thing is certain: the “August Recess” is over—for now. And Trump is making sure every Republican in Washington knows exactly who he expects to get the job done.
