Despite the clear rulings, the Biden-era judiciary is rehashing the case. The Trump administration, acting on its legal authority, deported Abrego Garcia after what officials described as full due process. Yet now, courtroom drama is unfolding over how and why the government sent him specifically to CECOT.

The legal tug-of-war intensified after the Supreme Court intervened with a vague directive, stating the Trump administration must “facilitate” Garcia’s release—while simultaneously stressing the need to respect the executive branch’s discretion in handling foreign affairs. The ruling left the door open for lower courts to second-guess Trump’s handling of the deportation.

As the legal teams battle over access to documents and communications, Judge Xinis accused the Trump administration of hiding behind executive privilege to block the release of key information. The government’s legal team argued that revealing more details could jeopardize sensitive diplomatic communications with El Salvador.

But lawyers representing Garcia say the administration is simply stonewalling. On Monday, they accused Trump-era officials of trying to cover up the details of Garcia’s transfer to CECOT, a prison known for housing some of the world’s most dangerous gang members.

On Tuesday, Judge Xinis ramped up her rhetoric, charging the Trump administration with “bad faith” and obstruction. She accused officials of dragging their feet and not complying with her court’s orders to hand over discovery materials.

“Defendants’ objection reflects a willful and bad faith refusal to comply with discovery obligations. The objection is overruled. Defendants are therefore ordered to supplement their answers in full compliance with the Federal Rules of Civil Procedure. Their answers must include facts responsive to the requests, not oblique and incomplete, non-specific characterizations,” she wrote in a scathing eight-page order reviewed by The Gateway Pundit.

Judge Xinis also demanded that the Trump administration disclose the full scope of any agreements or contracts between the United States and El Salvador, particularly in relation to the use of the CECOT facility.

This ruling has raised eyebrows, especially among those who believe Judge Xinis is using her bench to settle political scores. Critics argue that a federal judge overruling lawful deportation efforts involving a known MS-13 affiliate is a dangerous precedent—and a blow to national security.

“This is what happens when activist judges use their robes as political weapons,” one legal analyst noted. “The Trump administration followed the law and removed a violent criminal. Now, it’s being hauled back into court to answer for doing its job.”
