The decision came after Trump issued a June 7 order to federalize the National Guard in response to violent rioting, arson, and attacks on law enforcement across Los Angeles. That move triggered a legal battle, with Newsom claiming the situation didn’t meet the legal threshold for federal intervention—despite images of burning vehicles and mobs hurling rocks and bricks at police.
Newsom’s lawsuit argued that only a rebellion, invasion, or collapse in civil order justifies federal mobilization. Apparently, in his view, looting and chaos don’t qualify.
The lower court had previously ruled in Newsom’s favor, thanks to U.S. District Judge Charles Breyer, a Clinton appointee, who accused Trump of violating a statute that required National Guard actions to “go through the governor.” That ruling has now been completely overridden by the Ninth Circuit.
As expected, Trump took a victory lap on Truth Social, blasting Newsom while hailing the decision as a landmark win for public safety.
“BIG WIN in the Ninth Circuit Court of Appeals on the President’s core power to call in the National Guard! The Judges obviously realized that Gavin Newscum is incompetent and ill prepared, but this is much bigger than Gavin, because all over the United States, if our Cities, and our people, need protection, we are the ones to give it to them should State and Local Police be unable, for whatever reason, to get the job done,” the president wrote.
He continued, emphasizing the national implications of the decision.
“This is a Great Decision for our Country, and we will continue to protect and defend Law abiding Americans,” Trump added.
He closed his post with a jab at the left-leaning court, applauding their rare act of judicial sense.
“Congratulations to the Ninth Circuit, America is proud of you tonight!”
This decision doesn’t just put Newsom in check—it sends a warning shot to every Democrat governor who thinks they can stand in the way of federal efforts to restore law and order.
It’s also a devastating blow to Newsom’s national image. If this is a preview of his “leadership,” Americans should be terrified at the idea of him sitting in the Oval Office.
