President Donald Trump just scored a massive legal victory in his battle with California Governor Gavin Newsom—and the Ninth Circuit Court of Appeals handed it to him in decisive fashion.
The ruling, announced Friday, affirms Trump’s authority to take control of the California National Guard during times of emergency. This ruling blocks a lower court’s attempt to strip Trump of that power and give command to Newsom, who had sued to stop the federal mobilization during the Los Angeles riots.
A three-judge panel concluded that Trump acted within his authority, writing, “We conclude that it is likely that the President lawfully exercised his statutory authority.” The court sided with the president’s decision to deploy 4,000 National Guard troops to support federal law enforcement and protect federal property as the streets of Los Angeles descended into chaos.
