The program, often described by opponents as a backdoor to amnesty, was heavily expanded under Biden’s Department of Homeland Security. Under the so-called CHNV initiative, migrants from countries like Cuba, Haiti, Nicaragua, and Venezuela were flown directly into the United States by federal authorities. The Biden administration claimed this effort would reduce illegal crossings by providing a more “orderly” path into the country.

That claim hasn’t held up. Since the CHNV program was terminated on January 20, the day President Trump took office, illegal border crossings have plummeted to historic lows — proving, many argue, that the Biden strategy simply encouraged more unlawful migration.

The Supreme Court’s order was brief but impactful. Justice Ketanji Brown Jackson dissented, but the court’s remaining two liberal justices sided with the five conservatives in favor of the Trump administration’s emergency request. The decision paves the way for further litigation in the lower courts, but the immediate effect is unmistakable: deportations are back on the table.

At the heart of the case was an eleventh-hour move by the Biden administration in October 2023 to extend TPS protections — a decision that was extended again in January, just days before President Trump was sworn in. That protection was scheduled to last until 2026, but Homeland Security Secretary Kristi Noem moved swiftly in February to roll it back.

That rollback was halted by U.S. District Judge Edward Chen in California, who alleged the change was “racially motivated.” The Trump administration immediately pushed back, with Solicitor General D. John Sauer filing an emergency application to the Supreme Court.

“The court’s order contravenes fundamental executive branch prerogatives and indefinitely delays sensitive policy decisions in an area of immigration policy that Congress recognized must be flexible, fast-paced and discretionary,” Sauer argued.

Now, with the Supreme Court stepping in, the Trump administration can move forward with ending the Biden policy and begin deporting hundreds of thousands of foreign nationals who were granted temporary shelter under questionable legal authority.

Critics have long warned that the TPS program was being abused for political gain. Originally intended to provide short-term relief to individuals fleeing natural disasters or political unrest, it has ballooned under Democrats into a sweeping protection mechanism that many see as circumventing immigration law.

This ruling reaffirms what Trump supporters have argued all along: America’s immigration policy must serve the interests of its citizens, not be a revolving door for illegal entrants. With this decision, the border battle has taken a sharp turn — and it’s clear the Trump administration is not wasting time in undoing Biden’s legacy.
