The Supreme Court of the United States stepped in at the eleventh hour Monday, freezing a lower court’s order that threatened to upend how one of the nation’s most controversial abortion drugs is distributed.
In a fast-moving legal battle with nationwide implications, Justice Samuel Alito issued what’s known as an administrative stay. That temporary move blocks a ruling from the United States Court of Appeals for the Fifth Circuit, which had imposed new restrictions on the abortion pill mifepristone. The high court’s decision keeps current federal rules in place—at least for now.
The order buys time, but it does not settle the fight. The stay is set to remain in effect until at least May 11, though the justices could extend it as the legal drama unfolds behind the scenes.
A Legal Clash Over Federal Power
At the center of the storm is a challenge brought by the state of Louisiana against the Food and Drug Administration. The dispute stems from the FDA’s 2023 decision to loosen long-standing rules requiring that mifepristone be handed to patients in person.
