In a dissent from that case, Souter wrote that accepting the appeal would “tarnish the nation’s confidence in the judge as an impartial guardian of the rule of law.”

Known for his reclusive nature, Souter often shunned the spotlight, preferring the solitude of the New Hampshire countryside over the chaos of Washington, D.C. He was known for his simple habits, reportedly eating a yogurt and apple at his desk for lunch, and eagerly counting the days until summer recess, when he could return to the White Mountains or his family farm in Weare, New Hampshire.

After retiring in 2009 at the relatively young age of 69, Souter continued to speak out on the importance of civic education. He warned in a 2012 interview about the dangers of an uninformed electorate, saying, “What I worry about is that when problems are not addressed, people will not know who is responsible. And when the problems get bad enough … some one person will come forward and say, ‘Give me total power and I will solve this problem.’ That is how the Roman republic fell.”

Despite his reserved personality, Souter was known among his colleagues as a gifted orator, a passionate scholar of the law, and a beloved friend. Chief Justice John Roberts remembered his former colleague in a statement, saying, “Justice David Souter served our Court with great distinction for nearly twenty years. He brought uncommon wisdom and kindness to a lifetime of public service.”

Souter’s decision to step down in 2009 provided then-President Barack Obama his first opportunity to appoint a Supreme Court Justice, ultimately leading to the confirmation of Justice Sonia Sotomayor, the first Hispanic justice to serve on the nation’s highest court.

Souter leaves behind a legacy as a deeply principled jurist who defied expectations, choosing a path of independent judgment over ideological conformity. For those who knew him, his life and career stand as a testament to the importance of quiet integrity and steadfast commitment to the rule of law.
