Despite DHS’s announcement, Immigration Judge Philip P. Taylor argued there wasn’t enough proof that Garcia would, in fact, be sent to Uganda. He denied an emergency motion from Garcia’s defense team that attempted to stall the deportation process.

The judge wrote that Garcia “has not submitted evidence to show that the Department has presented him with a formal notice of removal or any other document showing its intent to remove him to Uganda.” In other words, the court believes DHS still has flexibility on where this convicted criminal will ultimately land.

A government attorney confirmed that Uganda was one possibility, but Eswatini and Costa Rica were also potential options for relocation.

Regardless of which nation accepts him, Garcia’s attempt to gain permanent residency in the U.S. has collapsed completely. His legal avenues are closed, and the ruling marks the end of a drawn-out saga that began when he was first arrested in March.

At that time, Garcia was transferred to a supermax prison in El Salvador. However, a judge eventually ruled that the deportation violated a 2019 arrangement that had temporarily allowed him to remain in the U.S. out of supposed fear for his life from rival gang members.

The case became even more controversial after it was revealed that Democrat lawmakers actually traveled overseas to meet Garcia while he was imprisoned in El Salvador. According to DHS spokeswoman Tricia McLaughlin, this shocking display showed exactly where their loyalties lie.

She reminded the public of this fact in a blunt social media statement: “Never forget the Democrats flew to a foreign land on the US taxpayer’s dime to break bread with this terrorist gang member and visit him in prison. While they continue to fight for criminal illegal aliens, we will continue to put the safety of the American people FIRST.”

The Trump administration had initially argued it could not bring Garcia back from El Salvador. But after securing a warrant tied to a 2022 trafficking case in Tennessee, officials succeeded in returning him to U.S. soil. Garcia pleaded not guilty to those charges and was temporarily released on bond.

That freedom didn’t last. Immigration authorities quickly rearrested him and began the formal deportation process that is now coming to its conclusion.

For now, the only certainty is that Garcia will not be staying in the United States. Whether he ends up in Uganda, Eswatini, or Costa Rica, Americans can be assured that one more violent criminal alien is being removed from their communities.
