But on Thursday, U.S. District Judge Stephanie Gallagher struck down the policy. She ruled that the Education Department “violated the law” when it threatened to defund universities that refused to abandon DEI.
According to the Associated Press, “A federal judge on Thursday struck down two Trump administration actions aimed at eliminating diversity, equity and inclusion programs at the nation’s schools and universities.”
Gallagher’s decision came after a lawsuit was filed by the American Federation of Teachers and the American Sociological Association. These groups, deeply tied to left-wing politics, asked the court to stop the Trump administration from cutting off schools that keep DEI alive. Unsurprisingly, the judge sided with them.
The case focused on two Department memos that explicitly told schools to halt “race-based decision-making” or risk losing taxpayer funds. Trump’s education officials argued that DEI programs are nothing more than legalized discrimination against white and Asian American students. The judge, however, sided with the unions and activists pushing to keep those programs in place.
The ruling exposes just how far the left will go to protect its racial favoritism. Programs that openly discriminate against certain groups are being upheld under the banner of “equity.” Meanwhile, the students most harmed by these policies—qualified kids denied opportunities because of their skin color—are left with no protection.
The judge’s order ensures that universities can continue funding offices that push divisive ideology, host segregated events, and reward students based on race rather than merit. For families who had hoped Trump’s policies would restore fairness in higher education, this decision is another blow.
It also raises the stakes for the upcoming election. Trump has made it clear that ending DEI is central to his vision of putting merit and fairness back at the center of education. Democrats, along with activist judges, appear determined to block him at every turn.
With billions of taxpayer dollars on the line, the fight over DEI is far from finished. What Thursday’s ruling makes clear is that the courts are now a central battlefield in the struggle over whether America’s schools will teach equality under the law—or division by race.
