To critics, this memo is not just an overreach—it’s a direct affront to the rule of law. Homan and other Trump-aligned officials argue that such a directive is a thinly veiled effort to create a sanctuary bureaucracy at the state level.

Faced with backlash, Evers backpedaled in a video statement, accusing Homan and conservative media of generating a “fake controversy.”
“The goal of this guidance was simple, to provide clear, consistent instructions to state employees and ensure they have a lawyer to help them comply with all federal and state laws. Nothing more, nothing less,” he insisted.

But the Democrat governor didn’t stop there—he lashed out at Republicans, Elon Musk, and so-called “right-wing allies,” accusing them of spreading lies and manufacturing outrage.
“I haven’t broken the law, I haven’t committed a crime, and I’ve never encouraged or directed anyone to break any laws or commit any crimes,” Evers claimed.

Still, the timing of the memo couldn’t have been worse for the governor. Just hours after it was sent, a Milwaukee County judge was arrested in a separate incident—further fueling allegations that state officials are intentionally undermining immigration enforcement.

Judge Hannah Dugan, who’s served nearly a decade on the bench, now faces felony charges for allegedly shielding an illegal immigrant accused of a violent crime. Eduardo Flores-Ruiz, a Mexican national, had been wanted for a brutal assault. After a court hearing, Dugan reportedly intervened to help him evade ICE agents. If convicted, she faces up to 10 years behind bars.

With Dugan’s arrest fresh in the headlines, the Evers memo is coming under sharper scrutiny. Legal experts and law enforcement officers argue the directive encourages state employees to obstruct lawful federal actions—raising serious questions about where the line is drawn between legal counsel and active resistance.

The guidance even goes as far as instructing state workers to deny ICE agents access to non-public areas unless they present a Judicial Warrant, and to hold all requests for review by Evers’ legal team—even if a valid warrant is in hand.

In his rebuttal, Evers tried to portray himself as the adult in the room, ending with a dramatic pledge:
“Overnight Republican lawmakers piled on encouraging the Trump administration to arrest me. Joint threats like this should be of concern to every Wisconsinite and every American who cares about this country and the values hold here. We live in the United States of America, folks. We are a country of laws. The rule of law matters. Following the law matters,” he said.
“I am not afraid. I will never be discouraged from doing the right thing.”

But critics aren’t buying the “nothing to see here” narrative. The plain reading of the memo suggests otherwise—and now that a sitting judge is facing criminal charges tied to similar conduct, the question becomes: Will Evers be next?

At a time when illegal border crossings are at record highs and enforcement is under intense strain, state-level defiance like this could have national implications. And with the Trump administration making clear they won’t let this slide, the legal showdown between federal immigration officers and defiant Democrat governors may just be getting started.

Should Evers be held accountable for what many are calling an orchestrated attempt to shield illegal aliens from justice? One thing is certain: Tom Homan isn’t bluffing.
