According to the U.S. State Department:

We highly encourage you to reevaluate your travel plans owing to the inconsistent application of local regulations, which includes the possibility of unlawful detentions and departure restrictions.

The People’s Republic of China’s administration has a propensity to arbitrarily enforce local laws. This involves imposing departure restrictions on both American citizens and nationals of foreign nations. These restrictions are frequently enacted without following a fair and open legal procedure.

The Department of State has noted the possibility of unjustified imprisonment of Americans by the Chinese authorities in China.

It is possible for Americans visiting or residing in the PRC to be held without having access to U.S. consular aid or knowledge of the allegations against them. This implies that American individuals may experience detention without charge or fair and open treatment under the law in China.

Businesspeople, former employees of foreign governments, academics, relatives of PRC citizens involved in legal proceedings, journalists, and other foreigners have all been detained and questioned by PRC authorities for alleged violations of national security laws. Additionally, the PRC has interrogated, detained, and expelled American citizens who are living and working there.

Due to China’s authorities’ considerable latitude in designating various sorts of material as state secrets, foreign nationals may face imprisonment and legal prosecution on espionage-related allegations. American and outside companies working in China are being more closely watched by the government, especially those offering professional services and performing due diligence. Americans should be warned that if they do research or access publically available materials while within Chinese territory, they may be arrested or subject to legal action.

Security officials have the right to detain and perhaps deport American citizens who criticize the governments of the People’s Republic of China, Hong Kong Special Administrative Region, or Macau Special Administrative Region in private electronic correspondence.

In addition, the People’s Republic of China (PRC) government has enacted exit prohibitions, often known as travel restrictions, in order to:

  • compel individuals to participate in PRC government investigations;
  • pressure family members of the restricted individual to return to the PRC from abroad;
  • resolve civil disputes in favor of PRC citizens; and
  • gain bargaining leverage over foreign governments.

U.S. citizens, take notice! When attempting to leave the PRC, be on the lookout for sudden exit prohibitions. Sadly, there might not be any avenue for judicial action to overturn these restrictions. Even the examined person’s family, including their children, may be impacted. Keep yourself educated and ready.

American tourists, take note: Important details for entering mainland China and having two nationalities. Please be aware that the PRC government does not recognize dual nationality, which means that dual citizens of the US and the PRC as well as US citizens with Chinese ancestry may experience more scrutiny and teasing. The PRC government may not notify the U.S. Embassy or Consulates General or provide you consular access if you are a U.S. citizen who decides to enter Mainland China using travel papers other than a U.S. passport and you are detained or arrested. When traveling, keep educated and be careful.

Consult the PRC Embassy in the United States for the most recent information about traveling to the People’s Republic of China (PRC). Additional COVID-19 testing for visitors visiting particular Mainland Chinese sites or events may be required in some circumstances. Be knowledgeable and organized before your vacation.
