At one point during the hearing, Le made an astonishing request — asking the judge to hold her in contempt and jail her.
“I wish you would just hold me in contempt of court so I can get 24 hours of sleep,” Le said, according to Fox 9.
The moment was as revealing as it was alarming. A federal attorney, tasked with defending the government’s actions, openly pleaded for incarceration as a form of relief from the pressure of her job.
Le went on to vent her frustration in blunt terms rarely heard in open court.
“The system sucks, this job sucks, I am trying with every breath I have to get you what I need,” the lawyer said.
Her comments painted a grim picture of a federal bureaucracy overwhelmed, understaffed, and unable to meet even basic legal obligations — all while immigration enforcement efforts continue at full speed.
According to Fox 9, Judge Blackwell ordered the hearing because he believed his authority was being disregarded across multiple cases.
“Judge Blackwell had ordered the SHOW CAUSE hearing because he was frustrated that in 5 Habeas cases he was presiding over, he felt his orders were being ignored, leaving immigrant detainees unconstitutionally locked up for days. Ms. Le said that govt lawyers just cannot keep up,” Fox 9 reported.
The situation is tied to “Operation Metro Surge,” a federal immigration initiative underway in Minnesota that has generated a surge of arrests — and an equally massive wave of legal challenges.
Fox 9 further detailed the judge’s concerns and the government’s response:
“A federal judge in Minnesota demanded to know why Immigration and Customs Enforcement (ICE) is not complying with court orders and failing to immediately release immigrants who are being wrongfully detained as part of Operation Metro Surge. A government attorney responded that the federal government’s system ‘sucks.’”
The report continued by outlining what is driving the chaos behind the scenes.
“What we know: Julie Le, an attorney working on behalf of the U.S. Attorney’s Office, admitted in court Tuesday that the government is ‘overwhelmed’ by the number of legal challenges coming out of Operation Metro Surge.”
Le appeared specifically to address why ICE has repeatedly failed to follow direct court orders during the ongoing operation — a failure that has now drawn judicial scrutiny and public attention.
During the hearing, Le became visibly emotional as she attempted to explain the situation to the judge.
“What they’re saying: ‘I am here to make sure the agency understands how important it is to comply with court orders,’ said Le, who became visibly emotional during the court hearing.”
While she claimed new procedures are being put in place to prevent future violations, she also admitted the process has been exhausting and chaotic.
“While Le said procedures are being implemented to ensure ICE complies with court orders moving forward, she admitted it has been like pulling teeth and has required non-stop work in an already depleted office.”
The courtroom episode has fueled criticism from conservatives who argue the Biden administration’s approach to immigration has created systemic breakdowns — overwhelming courts, straining federal agencies, and undermining the rule of law. When government lawyers are openly admitting the system is failing, critics say, the problem is no longer theoretical.
As immigration enforcement continues to dominate national debate, Tuesday’s hearing offered a rare and unsettling glimpse inside a federal system under immense pressure — one where even the lawyers tasked with defending it appear to be cracking.
