What Tariffs Were Struck Down

According to CNN, the order blocked Trump’s 30% tariffs on China, 25% on certain Mexican and Canadian goods, and the 10% blanket tariffs on most imports. However, tariffs on steel, aluminum, autos, and auto parts — which were implemented under a different law, Section 232 of the Trade Expansion Act — remain untouched.

This distinction shows the court is targeting Trump’s broader use of emergency powers while leaving intact tariffs tied to national security.

A Legal Back-and-Forth

This ruling is the latest chapter in a legal tug-of-war. Earlier this year, the Court of International Trade struck down Trump’s tariffs. In response, the appeals court temporarily reinstated them while the administration fought back.

Arguments were heard on July 31, and the tariffs stayed in place — until Friday’s decision permanently sided against Trump’s authority under IEEPA.

Trump Responds with Fire

Trump immediately blasted the ruling in a fiery Truth Social post, making it clear he isn’t backing down:

“ALL TARIFFS ARE STILL IN EFFECT! Today a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end. If these Tariffs ever went away, it would be a total disaster for the Country. It would make us financially weak, and we have to be strong.”

He went further, warning that the court’s decision would devastate American industries and workers.

“If allowed to stand, this Decision would literally destroy the United States of America. At the start of this Labor Day weekend, we should all remember that TARIFFS are the best tool to help our Workers, and support Companies that produce great MADE IN AMERICA products.”

Standing Firm on “America First”

Trump framed the fight as a battle for the very survival of American manufacturing and agriculture.

“For many years, Tariffs were allowed to be used against us by our uncaring and unwise Politicians. Now, with the help of the United States Supreme Court, we will use them to the benefit of our Nation, and Make America Rich, Strong, and Powerful Again!”

His message is clear: the appeals court may think it has the final say, but Trump is betting on the Supreme Court to restore his trade agenda.

What’s Next?

The legal fight over Trump’s tariffs is far from over. With the Supreme Court likely to take up the case, the outcome could reshape how much power a president has to wield tariffs as a tool of foreign policy and economic leverage.

For now, Trump is standing his ground. His tariffs remain in effect, and his base is likely to see this ruling as yet another example of partisan courts trying to undercut an America First agenda.
