After his conviction was upheld by an Illinois appeals court, actor Jussie Smollett is facing a serious setback. With this decision, he will be one step closer to serving a 150-day prison sentence for planning a fake hate crime.
A three-judge panel has rejected Smollett’s appeal by a resounding 2-1 vote. The central claim of his argument was based on Cook County State Attorney Kim Foxx’s initial decision to drop the case. But in the end, this decision was overturned, leading to a fresh indictment.

Two justices affirmed in a recent decision that Smollett will not be exonerated despite the decision to drop the prosecution. A dissenting justice, however, contended that Smollett was essentially guaranteed that the case was over by the prosecutor’s ruling.
Actor Smollett called 911 in 2019 to report that he was the victim of a violent assault by two people who yelled, “This is MAGA country.” He also claimed that the attackers threw bleach on him and put a “noose” around his neck, which he held onto while speaking with detectives.
When it was revealed that the attackers were Nigerian brothers Olabinjo and Abimbola Osundairo, Smollett’s credibility completely collapsed. These brothers provided testimony during Smollett’s trial, claiming that the actor had actually paid them to stage the “attack.” As a result, Smollett was found guilty on five of the six felony counts of disorderly conduct related to his false police statements.
“We wish to highlight that the decision was divided, with Justice Lyle offering a detailed analysis in favor of Smollett,” his rep told Fox News Digital.”We are preparing to escalate this matter to the Supreme Court, armed with a substantial body of evidence.”

Famous for his role in the popular television series “Empire,” Jussie Smollett was initially found guilty in 2022. In January 2019, he had stated that he was the victim of an anti-LGBTQ+ and discriminatory attack; however, this was later proven to be untrue. As a result, the actor was sentenced to 150 days in prison and 30 months of probation for the felony charge. In addition, he must pay a fine and make amends to the city of Chicago.
Smollett’s debut as a director and his ongoing involvement in the music business added to his appeal. His legal team presented a strong case regarding the circuit court judge’s obvious bias and the violation of his due process rights.

Smollett sought to have his 2019 conviction overturned during his September court appearance. His legal team contended that charges that Cook County District Attorney Kim Foxx had previously dropped were reinstated as a result of the case’s resurging public interest and unhappiness.
The actor’s legal team claims that the Fifth Amendment and the concept of double jeopardy are violated by the resuscitation of the charges. These protections forbid prosecutors from filing the same charges against a defendant twice. One of Smollett’s attorneys, Nenye Uche, highlights that the basic principles of justice should not take precedence over the public’s disapproval of the defendant.
Although the outcome of Smollett’s team’s appeal to the Supreme Court remains uncertain, preparations are currently underway. Smollett will have to serve out the remaining time in jail if his conviction is upheld.
