According to CBS News, the Supreme Court’s decision lifts a lower court’s temporary order that blocked federal immigration officials from stopping individuals in the Los Angeles area unless there was “reasonable suspicion” they were in the country illegally.
That order had prevented agents from conducting mass enforcement operations in seven Southern California counties, a favorite target for the Biden-aligned American Civil Liberties Union (ACLU), which sued to protect those in the country unlawfully.
The Ninth Circuit Court of Appeals — stacked with liberal judges appointed by Bill Clinton and Joe Biden — had previously backed District Judge Maame Ewusi-Mensah Frimpong’s July ruling, keeping Trump’s enforcement efforts on hold.
The three-judge panel consisted of Ronald Gould and Marsha Berzon, both Clinton appointees, and Jennifer Sung, a Biden pick.
In siding with Frimpong, the appeals court claimed that relying on factors such as “apparent race or ethnicity, speaking Spanish or speaking English with an accent, particular location, and type of work” amounted to profiling and therefore was not enough to justify immigration stops.
Judge Frimpong’s July order, cheered on by the ACLU, had blocked Trump’s Department of Homeland Security agents from conducting raids at car washes, Home Depots, and other worksites unless there was specific evidence of immigration violations.
This effectively gave sanctuary protections to entire regions, even as illegal immigration surged under Biden’s lax border policies.
Acting U.S. Attorney Bill Essayli praised the Supreme Court’s move, saying it was a critical step toward restoring law and order. The ruling now allows immigration agents to resume operations that had been stalled for months by activist lawsuits and sympathetic judges.
This Supreme Court decision marks a significant victory for immigration enforcement — and a sharp rebuke to the Biden administration’s allies in the judiciary who have tried to obstruct Trump’s agenda at every turn.
