“I want to tell you, Gorsuch. I want to tell you, Kavanaugh. You have released the whirlwind, and you will pay the price. You won’t know what hit you if you go forward with these awful decisions.”

Cruz reminded the committee that such rhetoric not only inflamed tensions but led to mobs protesting at justices’ homes — a direct violation of federal law, specifically U.S.C. Section 1507. That law makes it a crime to picket or protest near a judge’s residence with the intent to influence a case.

And yet, Cruz noted, “Night after night, angry mobs were outside the Supreme Court Justices’ homes, and the Biden Justice Department prosecuted nobody.”

That’s when Booker stepped in, visibly agitated, and tried to rewrite history.

“Will you indulge me for a moment? It’s just that something you said is actually dangerous and should be addressed,” Booker began. “This implication that there was silence (from us) at a time there were threats on people’s houses is absolutely absurd.”

He even tried to use Cruz’s own record against him, claiming, “I actually distinctly remember you, chairman, more than once condemning those attacks on, on, on Republican-appointed jurists.”

Booker accused Cruz of fanning partisan flames, saying, “To say things like that feeds just the partisanship in this institution… And it’s just plain not true. And I think you know that.”

But Cruz wasn’t buying it. “Facts are stubborn things,” he shot back, doubling down on his point that no Democrats held then-Attorney General Merrick Garland accountable for failing to enforce the law.

Booker then shifted his argument, saying Democrats did act — by supporting increased security for justices.

“Again, we joined together in a bipartisan way, not only to condemn that, but to pass legislation to extend round-the-clock security protection,” he said. “So if you’re saying that we didn’t criticize Merrick Garland…”

Cruz quickly cut him off: “Did the Biden DOJ go out and arrest a single person under this law?”

Booker danced around the question. Cruz pressed again, now adding the answer himself: “Again, the answer is no.”

That simple truth seemed to throw Booker into a tailspin. Raising his voice, he snapped, “I did not interrupt you, sir. I would appreciate it if you let me finish!”

While Cruz chuckled, Booker ranted about “heated partisan rhetoric” and blamed President Trump for threatening judicial independence — a deflection that had little to do with Cruz’s original point.

Still dodging the question, Booker tried to reframe the discussion again: “You said we were silent after people’s houses were protested. That is a patent lie, sir. We were not silent. We took action.”

But Cruz calmly pointed out that, for all his indignation, Booker still had not answered the fundamental question: should the law have been enforced?

“So let the record reflect that Spartacus did not answer the question,” Cruz quipped, referencing Booker’s cringe-worthy “Spartacus moment” during the Kavanaugh hearings. “And did not tell us whether the criminal law should be enforced, because he knows the answer is yes.”

Cruz then nailed the larger issue: “He knows that the Biden Department of Justice was being wildly political and partisan in refusing to enforce the law because they disagreed with the Supreme Court Justices’ rulings.”

The exchange ended with Cruz firmly in command and Booker visibly rattled. What started as a typical Senate debate turned into a brutal takedown — and a clear reminder that facts, no matter how inconvenient for the Left, don’t go away.
