A federal appeals court has dismissed the Justice Department’s misconduct complaint against Judge James Boasberg, the judge who famously blocked deportations of dangerous Venezuelan gang members under President Trump. Boasberg had even turned deportation planes around mid-flight, allowing convicted criminals to remain in American communities.
The ruling has alarmed conservatives who argue that the federal judiciary is increasingly unaccountable and acting as a rogue branch of government.
DOJ Misconduct Complaint Tossed Over “Flimsy Excuse”
Chief Judge Jeffrey Sutton of the Sixth Circuit threw out the DOJ complaint on December 19, though the ruling was only recently made public. The complaint alleged that Boasberg had made improper remarks at a March 2025 Judicial Conference, warning that Trump’s administration could trigger a “constitutional crisis” by ignoring court orders.
The issue: Boasberg allegedly said this at a private conference just days before stopping deportation flights. Then he did exactly what he had hinted he would—blocking Trump’s effort to remove dangerous gang members from U.S. soil.
