The Supreme Court of Oregon has declared its support for legality. On Friday the court declined to hear the case aimed at barring former President Donald Trump from appearing on Oregon’s primary and general election ballots, deferring instead to the U.S. Supreme Court’s forthcoming ruling on a similar matter.
There has been a major move to contest Trump’s eligibility for office amid a national campaign by Democratic groups. The 14th Amendment, which bars anyone engaged in insurrection from holding public office, serves as the foundation for this.

“A decision by the United States Supreme Court regarding the Fourteenth Amendment issue may resolve one or more contentions that relators make in this proceeding,” the statement read.
“Given that possibility, we deny relators’ petition for a writ of mandamus at this time, without prejudice to relators’ ability to file a new petition seeking resolution of any issue that may remain following a decision by the United States Supreme Court.”
A nationwide advocacy organization named Free Speech for People spearheaded a legal action in Oregon with the goal of forcing the state’s secretary of state to uphold the 14th Amendment’s provisions.
State attorneys contend that it is not the province of individual states to assess a presidential candidate’s eligibility. This position is consistent with the idea that judging presidential candidates’ constitutional qualifications belongs to the federal government.

The Trump campaign’s spokesperson, Steven Cheung, stated that he agreed with the Oregon verdict. He emphasized President Trump’s demand for the swift dismissal of any remaining challenges to the 14th Amendment ballots that are deemed to be in bad faith and tamper with the election process in a statement, saying, “Today’s decision was the right one.”
The US Constitution’s famous “Disqualification Clause,” found in Section 3 of the 14th Amendment, deals with people who have engaged in insurrection or rebellion against the US government.
The 14th Amendment’s Section 3 states:
“No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”
The 14th Amendment’s Section 3 mandates that people who have previously sworn allegiance to the U.S. individuals who signed the US Constitution and then took part in acts of rebellion or insurrection against the country, or supported those who did, are not eligible to hold federal or state office. Congress can, however, override this disqualification with a two-thirds majority vote in each House.
The importance of Section 3 of the 14th Amendment became evident following the breach of the U.S. Capitol on January 6, 2021.
