Just hours after the U.S. Supreme Court dealt a serious blow to a core piece of his trade strategy, Trump announced a sweeping new move that could reshape global commerce yet again. Standing firm, the president declared he will invoke Section 122 authority to impose a 10 percent global baseline tariff, signaling that America First trade policy is far from finished.
The high court ruled 6-3 that Trump exceeded his authority when he relied on the International Emergency Economic Powers Act to impose broad tariffs on specific countries. The majority found that the statute did not authorize the kind of blanket trade penalties the administration had pursued.
Trump made clear he believes the court got it wrong.
“I’m ashamed of certain members of the court, absolutely ashamed for not having the courage to do what’s right for our country,” Trump said during a White House press briefing.
The president singled out Justices Samuel Alito, Clarence Thomas, and Brett Kavanaugh for siding with him in dissent. At the same time, he took aim at the liberal justices, describing them as predictable opposition votes. He said he at least respected their consistency, a pointed remark that appeared aimed at conservative justices who joined the majority.
