In a stunning move that’s leaving conservatives fuming, Senate Minority Leader John Thune (R-SD) has effectively kneecapped former President Donald Trump’s ability to install key nominees during the Senate’s August recess. The maneuver, subtle yet devastating in its impact, could stall over 150 critical appointments—many of them judicial—for the foreseeable future.
At the heart of the issue is a constitutional mechanism known as the Recess Appointments Clause, which allows presidents to bypass Senate confirmation by making temporary appointments when Congress is not in session. These appointments hold until the end of the next congressional session, giving presidents a rare workaround in the face of obstruction.
But John Thune, rather than standing firm with the America First agenda, has chosen instead to weaponize a Senate technicality to block this executive authority.
Thune reportedly secured unanimous consent for a thinly veiled schedule of pro forma sessions—symbolic meetings where no real business occurs but which technically keep the Senate “in session.” This clever trick is just enough to sidestep triggering the 10-day formal recess needed to activate Trump’s recess appointment powers.
