In a landmark move Monday, the Supreme Court overturned a lower court ruling that upheld New York’s strict school vaccine mandate, which excludes religious exemptions. The justices instructed the appeals court to reconsider the case with a fresh emphasis on parental rights.
The case centers on Amish families who challenged the law after New York eliminated religious exemptions in 2019, despite previously allowing them, according to The Washington Times.
Both a federal district court and the 2nd U.S. Circuit Court of Appeals had sided against the families, effectively enforcing the state’s strict vaccination requirements.
Now, the Supreme Court has vacated the 2nd Circuit’s opinion, wiping it from the record and sending a clear message that parental rights must be weighed carefully in such cases.
Kelly Shackelford, president of First Liberty Institute, which represented the Amish families, hailed the order as a major victory.
