Professor’s SCOTUS Analysis Shakes Washington

In a 6 to 3 decision, the high court blocked President Donald Trump from continuing to rely on the International Emergency Economic Powers Act to impose sweeping tariffs on foreign trading partners without Congress signing off.

For the White House, it was a setback in a signature economic fight. For critics of executive overreach, it was a constitutional line in the sand. And for legal scholars watching closely, the story may be far from finished.

Chief Justice John Roberts, writing for the majority, left little ambiguity about where the Court stands on tariff authority.

“The Framers gave that power to ‘Congress alone’ — notwithstanding the obvious foreign affairs implications of tariffs,” Roberts wrote. “And whatever may be said of other powers that implicate foreign affairs, we would not expect Congress to relinquish its tariff power through vague language, or without careful limits.”

The ruling centered on Trump’s use of two specific terms inside the emergency statute — words the administration argued provided independent authority to regulate imports at will.

  1. Good for SCOTUS,John Roberts! Who or what does Trump think he is! He’s no king or god or anything that he can rule the universe. Trump is certainly not rebuilding this economy. Every time I look at something I’d like to buy whether it’s good for my health,the price jumps $3.00 more than the prior month.
