Despite the setback, Democrat Nevada Attorney General Aaron Ford is determined to challenge the dismissal. “The judge got it wrong, and we’ll be appealing immediately,” Ford asserted, indicating the state’s commitment to pursuing the case further.

However, the defense sees this as a conclusive end to the proceedings in Clark County. “They’re done,” declared Margaret McLetchie, attorney for Clark County Republican party chairman Jesse Law.

The controversy stems from actions taken after the 2020 presidential election. A grand jury indicted six individuals, accusing them of masquerading as Nevada’s legitimate presidential electors. They face charges of Offering a False Instrument for Filing and Uttering a Forged Instrument, serious felonies that involve submitting a fake “Certificate of the Votes of the 2020 Electors from Nevada” to several federal and state authorities.

In his initial announcement of the charges, Attorney General Ford emphasized the significance of the case for democracy. “We cannot allow attacks on democracy to go unchallenged. Today’s indictments are the product of a long and thorough investigation, and as we pursue this prosecution, I am confident that our judicial system will see justice done,” Ford stated.

Defense arguments highlighted procedural issues, notably the appropriateness of the venue. Richard Wright, representing one of the accused, argued that the grand jury’s convening in Las Vegas was improper, claiming that the prosecutors did not provide potentially exculpatory evidence.

Deputy State Attorney General Matthew Rashbrook countered by saying that the nature of the crimes transcends county lines, affecting society at large and potentially disenfranchising voters.
