“On March 9, 2025, in support of President Trump’s executive orders prohibiting anti-Semitism, and in coordination with the Department of State, U.S. Immigration and Customs Enforcement arrested Mahmoud Khalil, a former Columbia University graduate student,” ICE spokesperson McLaughlin said in a statement to Columbia Spectator.

“Khalil led activities aligned to Hamas, a designated terrorist organization… ICE and the Department of State are committed to enforcing President Trump’s executive orders and to protecting U.S. national security,” she added.

Despite clear legal grounds for his detention, Khalil’s allies in left-wing legal circles immediately jumped to his defense, filing a habeas corpus petition that framed his arrest as “retaliation” for his so-called free speech rights.

His attorneys argued that moving him to a Louisiana detention facility was a deliberate move to disrupt the legal proceedings.

Khalil’s lawyer, Amy Greer, filed a motion demanding ICE return him to New York, claiming his transfer was an effort to obstruct justice.

According to legal filings in the U.S. District Court for the Southern District of New York, Khalil—who is married to a U.S. citizen and expecting a child next month—was taken from his student housing on March 8, 2025.

Within hours of his lawyers filing their petition, ICE transferred Khalil to Louisiana, a thousand miles away, allegedly without informing his legal team. His attorneys claim this was a retaliatory move designed to remove the case from the court’s jurisdiction.

On Monday, Furman issued an order in the Southern District of New York, ruling that Khalil “shall not be removed from the United States unless and until the Court orders otherwise.”

The judge invoked the All Writs Act, which allows federal courts to issue necessary orders to protect their jurisdiction.

This decision is nothing short of a judicial power grab, wrapped in legalese to protect a radical activist. The Trump administration had taken decisive action to remove foreign extremists who pose a threat to American security, yet Furman’s ruling echoes the same liberal elitism that prioritizes the interests of radical agitators over the safety of American citizens.
