President Trump himself did not mince words when addressing the controversy, issuing a stark warning on Truth Social:

“SEDITIOUS BEHAVIOR, punishable by DEATH!”

Behind the scenes, the Department of War began reviewing whether Kelly—who retired as a Navy captain and continues to receive military retirement pay—could be recalled for court-martial proceedings. While that option remains on the table, Secretary Hegseth announced Monday that he is instead initiating administrative punishment that could permanently damage Kelly’s military legacy and financial benefits.

According to the Department of War, Kelly’s status as a retired officer does not shield him from accountability under the Uniform Code of Military Justice. Retired officers who receive pay remain subject to military law, a fact long recognized but rarely enforced at this level against a sitting U.S. senator.

Hegseth laid out the administration’s reasoning in a forceful and detailed statement released Monday. The secretary made clear that Kelly’s conduct crossed a line that could not be ignored:

“Six weeks ago, Senator Mark Kelly — and five other members of Congress — released a reckless and seditious video that was clearly intended to undermine good order and military discipline. As a retired Navy Captain who is still receiving a military pension, Captain Kelly knows he is still accountable to military justice. And the Department of War — and the American people — expect justice.”

Hegseth then announced the specific punishment being imposed:

“Therefore, in response to Senator Mark Kelly’s seditious statements — and his pattern of reckless misconduct — the Department of War is taking administrative action against Captain Mark E. Kelly, USN (Ret). The department has initiated retirement grade determination proceedings under 10 U.S.C. § 1370(f), with reduction in his retired grade resulting in a corresponding reduction in retired pay.”

In addition to the financial penalty, Hegseth confirmed that Kelly has been formally censured—a rare and serious action in military circles:

“To ensure this action, the Secretary of War has also issued a formal Letter of Censure, which outlines the totality of Captain (for now) Kelly’s reckless misconduct. This Censure is a necessary process step, and will be placed in Captain Kelly’s official and permanent military personnel file.”

Kelly has been notified of the action and given a limited window to respond:

“Captain Kelly has been provided notice of the basis for this action and has thirty days to submit a response. The retirement grade determination process directed by Secretary Hegseth will be completed within forty five days.”

Perhaps most striking was Hegseth’s blunt reminder that elected office does not place anyone above military law:

“Captain Kelly’s status as a sitting United States Senator does not exempt him from accountability, and further violations could result in further action.”

The Department of War concluded by explaining why the conduct rose to the level of a serious offense:

“These actions are based on Captain Kelly’s public statements from June through December 2025 in which he characterized lawful military operations as illegal and counseled members of the Armed Forces to refuse lawful orders. This conduct was seditious in nature and violated Articles 133 and 134 of the Uniform Code of Military Justice, to which Captain Kelly remains subject as a retired officer receiving pay.”

For conservatives, the move is being hailed as a long-overdue stand against politicization of the military and a warning shot to lawmakers who use their platforms to interfere with command authority. Whether further punishment follows may depend on Kelly’s response—but one message from the Trump administration is now unmistakably clear: no rank, title, or Senate seat places anyone above military discipline or the rule of law.
