The case was brought to the Court by the ACLU, which claimed that the detainees were being secretly removed without proper notice. According to their emergency filing, notices were issued “in English only,” and some detainees were told they would be removed “within 24 hours.” The ACLU alleged that people had already been “loaded on to buses.”

That was apparently enough for the liberal justices, who issued an emergency injunction before the Fifth Circuit Court of Appeals—the appropriate legal body—had even ruled.

“This Court had jurisdiction only if the Court of Appeals had jurisdiction of the applicants’ appeal, and the Court of Appeals had jurisdiction only if the supposed order that the applicants appealed amounted to the denial of a preliminary injunction,” Alito explained.

But in this case, there was no denial—no formal ruling at all. The ACLU simply claimed that the district court was taking too long, and that amounted to a “constructive denial.” In Alito’s eyes, that’s not how the law works. Not even close.

“But here, the ‘order’ that applicants appealed was what they viewed as the District Court’s ‘constructive’ denial of their request for a temporary restraining order (TRO),” he added.

This wasn’t just a case of jumping the gun—it was a complete disregard for the chain of judicial command. The Fifth Circuit had been actively reviewing the case and, according to Alito, was “in the process of issuing a decision.” But the Supreme Court’s liberal justices didn’t wait. They took action anyway.

“When this Court rushed to enter its order, the Court of Appeals was considering the issue of emergency relief, and we were informed that a decision would be forthcoming. This Court, however, refused to wait,” Alito blasted.

Adding insult to injury, the majority didn’t even wait for the government to respond—something Alito emphasized violates the Court’s own long-standing procedures.

“The Executive must proceed under the terms of our order in Trump v. J.G.G.,” he said, referencing a recent precedent that the majority ignored. “This Court should follow established procedures.”

Alito wasn’t just upset about the timing. He was furious over what he sees as a dangerous new precedent—one where activist groups like the ACLU can trigger emergency judicial intervention without an actual legal ruling to appeal.

“Both the Executive and the Judiciary have an obligation to follow the law,” Alito warned.

While left-wing groups are cheering the ruling as a “human rights” win, critics are calling it a disturbing case of judicial activism—one that empowers illegal foreign actors over the will of the American people and the authority of the Commander-in-Chief.

With violent gangs like Tren de Aragua gaining a foothold on U.S. soil, Alito’s warning is clear: this isn’t just about legal technicalities—it’s about national security.

And once again, the Court’s liberal majority seems more interested in protecting criminal foreigners than backing America’s elected president.
