In a stunning late-night move that has left legal experts and patriots across the country shaking their heads, the U.S. Supreme Court’s liberal wing quietly halted President Trump’s attempt to deport violent foreign nationals tied to the notorious Venezuelan gang Tren de Aragua—individuals currently held at a detention facility in Texas.
The high court’s unsigned emergency order, dropped just before midnight, forbids the federal government from removing the detainees under the Alien Enemies Act, a centuries-old statute that empowers the president to expel foreign threats during times of war or national emergency. The justices gave no explanation, no legal rationale—just a sudden command to halt Trump’s deportation directive.

But Justice Samuel Alito, joined by Justice Clarence Thomas, wasn’t having it.
In a rare and fiery rebuke of his own colleagues, Alito slammed the majority’s ruling as rushed, reckless, and devoid of legal merit.
“Literally in the middle of the night, the Court issued unprecedented and legally questionable relief without giving the lower courts a chance to rule, without hearing from the opposing party, within eight hours of receiving the application, with dubious factual support for its order, and without providing any explanation for its order,” Alito wrote.
