The IRS looked into a charity after a whistleblower lawsuit was brought against it in 2017. Judge David Gustafson of the U.S. Tax Court, however, asked the IRS to divulge whether it had initiated a criminal inquiry when he spotted a worrisome “gap” in its data. The deadline for new arguments has been extended to June 30 for Moynihan, a former federal agent, and Doyle, a specialist in corporate tax compliance. The IRS has until July 28 to react, meanwhile.

“Ultimately, the foundation and its auditors conceded in formal submissions that it did operate as a (foreign) agent; therefore, the foundation is not entitled to its 501c3 tax-exempt privileges as outlined in IRS 170 (c)2,” he added.

Although the charity acknowledges having compliance difficulties in prior audits, they guarantee that the issues have been fixed.

Gustafson denies the request for summary judgment, and the IRS whistleblower prosecution against the foundation continues. Unknown information implies that the FBI and IRS may be collaborating on a criminal probe.
