The Democratic Party just suffered a devastating political and financial gut punch in Virginia — and donors are now left wondering how tens of millions of dollars vanished into a redistricting scheme that the courts ultimately declared illegal.
In a crushing decision Friday, the Virginia Supreme Court struck down the state’s controversial congressional redistricting referendum, wiping out what Democrats hoped would become one of their biggest power grabs heading into the 2026 midterms.
The ruling not only destroyed Democrats’ dream of engineering a near-total lock on Virginia’s congressional delegation, but it also exposed a major problem for a party already drowning in debt and struggling to keep donors engaged after the disaster of 2024.
The court ruled 4-3 that Democrats violated Virginia’s Constitution while rushing the referendum through the legislature.
Under Virginia law, constitutional amendments must pass during two separate legislative sessions with an election in between. Democrats attempted to jam the measure through after early voting had already begun — a move the court said fatally tainted the process.
