By issuing Texas a cease-and-desist letter, the Biden administration has demonstrated its hard position. This letter directs national guard members and state law enforcement to leave Eagle Pass’s Shelby Park. Large gangs of illegal aliens have recently made this public park their gathering place. Before, Texas authorities had taken over the park, alleging that Border Patrol members were subtly encouraging illegal immigration.
An important step in the continuing disagreement between Texas and the Biden Administration over border law enforcement is the ongoing stalemate in Shelby Park. Through Operation Lonestar, Texas Governor Greg Abbott has taken the lead in sending law enforcement and national guard members to the border. Furthermore, a newly enacted statute that has been contested as illegal by the Biden Administration gives Texas officials the power to arrest illegal aliens and allows judges to assist in their deportation.

Jonathan Meyer, the general counsel for the Department of Homeland Security, wrote Texas Attorney General Ken Paxton on Tuesday, claiming that Operation Lonestar is not only unlawful but also putting border crossers’ lives in jeopardy. “The recent actions by the State of Texas have impeded operations of the Border Patrol,” Meyer wrote. “Those actions conflict with the authority and duties of Border Patrol under federal law and are preempted under the Supremacy Clause of the Constitution.”
Meyer went on to say that the Lonestar State’s measures aim to “regulate the federal government.”
“I am writing to demand that Texas immediately cease and desist any actions taken by the State that block Border Patrol’s full access to the U.S.-Mexico border in and around the Shelby Park area,” the letter continued.
Meyer implied that Texas’ actions were to blame by citing a recent instance in which a lady and two children perished in the Rio Grande at Eagle Pass. “Texas’s failure to provide access to the border persists even in instances of imminent danger to life and safety,” Meyer wrote. “Texas has demonstrated that even in the most exigent circumstances, it will not allow Border Patrol access to the border to conduct law enforcement and emergency response activities.”
Texas has categorically refuted the charges made by the federal government, referring to them as “wholly inaccurate.” According to the Texas Military Department, Mexican officials informed Border Patrol personnel about the event after they had already taken the remains out. According to the agency, Border Patrol requested entrance expressly so they could look for possible witnesses to the event.
Regarding the event, an official from the White House stated that it is “clear” that Abbott’s “political stunts are cruel, inhumane and dangerous.”
Abbott is committed to carrying out Operation Lonestar despite the growing tensions. “We’re not going to let this happen anymore,” he stated earlier this week in a statement.
