In a major legal victory for President Donald Trump, a federal appeals court has confirmed that presidents can’t be overruled by the judiciary simply because judges disagree with their decisions. The ruling is a firm reminder of the limits of judicial power when it comes to the Commander-in-Chief’s authority.
The Ninth Circuit Court of Appeals unanimously backed Trump’s decision to deploy the National Guard in Los Angeles during widespread riots. In its ruling, the court said Trump “lawfully exercised his statutory authority” when he responded to violent unrest triggered by ICE raids targeting criminal illegal immigrants.
CNN’s Elie Honig admitted the ruling was a blow to the left’s legal crusade against Trump. “It’s huge, Pam, because it goes to presidential powers and the extent of them,” Honig said on The Situation Room. “So the core ruling here from the Ninth Circuit Court of Appeals is yes, the federal courts have some role in reviewing the president’s decision to deploy the National Guard; however, the courts cannot just second-guess the president and overturn him if they disagree.”
