Trump’s Ballot Battle: Unexpected Judge’s Ruling!

The decision by a federal judge to bar Donald Trump from the 2024 presidential election is a setback for his rivals in politics.

The United States has dismissed a lawsuit meant to keep Trump off the West Virginia ballot. Obama appointed Irene Berger as a district judge. John Anthony Castro, a little-known Texas Republican presidential candidate, filed the lawsuit. Castro has unsuccessfully brought many similar complaints against Trump.

Castro referenced the United States Fourteenth Amendment, Section 3. Constitution, which revokes the rights of individuals who have rebelled or committed acts of insurrection against the state. The Colorado Supreme Court recently ruled that Trump is not permitted to appear on the state’s ballot, citing this section in their decision.

On the other hand, Berger rejected the assertion and asserted that the evidence makes it clear that there is no room for doubt about Mr. Castro’s purported “campaign,” adding that its goal is to pursue legal action rather than win support.

In her ruling, Berger stated, “The plaintiff alleged that he is a candidate for the Republican nomination for president and anticipates being on the ballot in West Virginia.” There aren’t many precise factual accusations about his candidacy in his complaint.

Berger’s decision further stated, according to the outlet, that “Castro’s complaint relies on supposition and speculation that if Mr. Trump were removed from the ballot, that his voters and contributors would default to other candidates including Mr. Castro.”

“But he supplies no specifics to support the conclusion that Trump voters would become Castro voters if his suit was successful.”

Attorney General Patrick Morrisey of West Virginia praises the judge’s decision and expresses gratitude for his office’s intervention in halting the lawsuit.

“Any eligible candidate has the right to be on the ballot unless legally disqualified, and we will defend the laws of West Virginia and the right of voters and candidates to the fullest,” he said, per the outlet.

The Colorado Supreme Court, which is made up solely of justices nominated by Democrats, ruled 4-3 to disqualify Trump in a historic and divisive decision.

Four justices—William W. Hood III, Melissa Hart, Richard L. Gabriel, and Monica Márquez—made the decision. Democratic governors nominated each of these justices, and a thorough background check was done before the ruling.

Colorado’s highest court welcomed Justice Richard L. Gabriel, a distinguished Yale alumnus and Penn law school graduate, to its ranks in June 2015. Nonetheless, controversy has clouded his tenure. In 2021, a female law clerk allegedly accused him of harassment, according to the Denver Post.

In December 2017, the Colorado Supreme Court appointed Justice Melissa Hart, a Harvard Law School alumna with distinction, to the bench. She had a fruitful tenure as a professor at Colorado’s law school before being appointed. According to recent reports in The Daily Mail, Hart was involved in an African-American job applicant’s discrimination case that the Supreme Court ultimately dismissed. It is alleged that Michele Brown was subjected to age and race discrimination by Hart and the other judges when she was not chosen for the position of rules attorney.

As the first Latina and openly gay justice to serve on the Colorado Supreme Court, Justice Monica Márquez made history in 2010 after graduating with honors from both Stanford University and Yale Law School. On the other hand, there are claims that her political connections, rather than an unbiased evaluation of the legal merits, influenced her decision regarding the Trump ballot issue.

Appointed in January 2014, Justice William W. Hood III is a distinguished graduate of UVA Law School.
