In a stunning move, Trump has designated the cartels as unlawful combatants and declared the United States is in an “armed conflict” with them, according to an administration memo obtained by the Associated Press.
This comes directly on the heels of U.S. military strikes on cartel-linked boats in the Caribbean — a signal that Trump is unleashing America’s military might against what he calls a direct national security threat.
A Bold Expansion of War Powers
The memo outlines an aggressive interpretation of presidential authority, treating cartel drug smuggling not as simple crime but as warfare. That framing allows Trump to order military action under the law of armed conflict, rather than wait for traditional law enforcement to act.
“The President determined that the United States is in a non-international armed conflict with these designated terrorist organizations,” the memo states. Trump then directed the War Department to “conduct operations against them pursuant to the law of armed conflict.”
