In a move that has immigration enforcement advocates sounding alarms, a federal judge in Illinois is reportedly preparing to order the mass release of thousands of illegal aliens detained under ICE’s nationwide crackdown on criminal and repeat immigration violators, known as “Operation Blitz.”
According to ABC7 Chicago, U.S. District Judge Jeffrey Cummings, a Biden appointee, is considering granting “equitable relief” that could force federal immigration authorities to release thousands of detainees. Those released could be enrolled in so-called “alternatives to detention” programs, tracked with ankle monitors, or subjected to smartphone check-ins—measures widely criticized as ineffective and easily exploited by law enforcement experts.
The legal battle traces back to the 2022 Castañon Nava settlement, a consent decree that severely restricts ICE agents’ ability to conduct warrantless arrests in Illinois and surrounding states. Under the decree, agents must first establish “probable cause” that a person is in the country illegally and poses a flight risk. Immigration advocates now claim ICE violated these requirements during recent raids.
