Judge rejects motion from Trump legal team to recuse herself from Colorado primary ballot case.
The former president’s legal team recently learned that Denver District Court Judge Sarah B. Wallace had donated money to the Colorado Turnout Project. This in turn led to another request. Colorado Politics is a source.

“Its website proudly proclaims that the group was formed ‘shortly after Colorado Republicans refused to condemn the political extremists who stormed the United States Capitol on January 6, 2021,’” in the Saturday-filed motion for Wallace’s recusal, attorney Scott Gessler wrote.
Gessler stressed that contributing to the Colorado Turnout Project means endorsing the notion that what happened on January 6, 2021, qualifies as a “insurrection.”
Wallace, a former $100 donor to the organization, voiced his disapproval upon being appointed to the bench.
“I can assure all of the litigants that prior to the start of this litigation and to this day, I have formed no opinion whether the events of Jan. 6 constituted an insurrection,” Wallace stated in reaction to the proposal.
She declared that she was indifferent to the issues that would be decided at this hearing, including whether or not Trump took part in an insurrection.
She stressed that although she did not dispute the contribution made somewhat more than a year ago, it was not typical of her.
“I do not dispute that on (October 15, 2022), prior to taking the bench, I apparently made a $100 contribution to the Colorado Turnout Project. That being said, prior to yesterday, I was not cognizant of this organization or its mission,” she said.

“It has always been my practice, whether I was entirely successful or not, to make contributions to individuals, not PACs (political action committees),” she added.
The question of whether Trump’s activities on January 6, 2021, qualify as a “insurrection” will probably be a major point of contention in Wallace’s current case.
One of the main questions at hand is whether the 14th Amendment should forbid Trump from being on Colorado’s primary ballot. According to this amendment, anyone who has taken part in acts of rebellion or insurrection against the United States. Constitution is not qualified to run for public office.
“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof,” Section 3 of the amendment reads. “But Congress may by a vote of two-thirds of each House, remove such disability.”
The paper states that Colorado forbids judges from accepting political contributions. But in line with Rule 4.1 of the state’s Code of Judicial Conduct, this ban only applies to judges and candidates for judicial office.
Wallace was not a candidate or a judge in October, according to the plaintiffs, when she made the donation. But Colorado Politics pointed out that back in August, the announcement of her nomination to the bench had been made.
This week marks the conclusion of the much awaited Anderson et al. v. Griswold lawsuit. The precise moment the judge made her ruling is still unknown, though.
