Homan clarified that ICE agents don’t rely on looks alone — they assess a range of indicators before taking action.
“It’s articulable facts, with an S. So appearance can be just one. For instance, if someone has an MS-13 tattoo on their face, that may be one factor to add to other factors to raise reasonable suspicion,” Homan explained.
Far-left judges and media outlets are cherry-picking Homan’s comments to fit their anti-enforcement agenda. But Homan wasn’t having it.
“I want to be clear about that again, because my words were taken out of context. Physical description cannot be the sole reason to detain and question somebody,” he clarified.
He also reminded viewers that ICE officers aren’t cowboys — they’re professionals trained to operate within the law.
“Every ICE officer goes through Fourth Amendment training every six months, and reminded what their authorities are for arrest, detention, and questioning. So, the officers are very well-trained,” Homan said.
One radical federal judge recently issued a ruling to limit the criteria ICE agents can use to determine “reasonable suspicion.” The judge claimed that ethnicity, location, language, and even line of work shouldn’t count toward reasonable suspicion — a ruling that could cripple ICE’s ability to do its job.
But Homan wasn’t afraid to speak out.
“Well, like I said, it’s just — these are factors that lead to reasonable suspicion. There’s a myriad of factors. Every case is different,” he responded.
He emphasized that ICE doesn’t act on just one clue — officers make decisions based on a combination of legitimate observations.
“I’m not going to disagree with everything the judge has said, because a location alone shouldn’t have reasonable suspicion. It’s a combination of articulable facts that an officer determines before he detains somebody for a short period of time and questions them,” Homan noted.
Homan didn’t hold back when addressing the judge’s ignorance of field realities.
“I look forward to DOJ litigating this judge’s decision, because I don’t — I think she is making a decision without knowing what that officer knows when they get out of that vehicle to question somebody,” Homan said.
And he made it clear: this administration isn’t rolling over.
“The administration is never going to go against a judge’s order. We will litigate it. We will win it. And then we will get back to doing what we’re doing,” he promised.
In a desperate attempt to gin up fear, CNN’s Bash tried to claim that legal immigrants are terrified of ICE. But Homan tore that narrative apart in seconds.
“There’s no – if they’re in the country legally, they got no reason to be afraid,” he said plainly.
He laid out the truth: ICE isn’t chasing people here legally — they’re going after those who broke the law and pose a threat.
“ICE is looking for those in the country illegally. And we’re still prioritizing public safety threats and national security threats. That’s the priority,” Homan said.
The operations aren’t random either — they’re carefully planned and executed.
“Most of the operations we conduct are targeted enforcement operations. When we go out, we know exactly who we’re looking for, most likely where we will find them. Many times, we have a criminal history and immigration history… when we go out looking for that person,” Homan explained.
And to those who try to scare law-abiding immigrants? Homan made it clear — ICE isn’t coming for you.
“Legal aliens shouldn’t and U.S. citizens should not be afraid that they’re going to be swept up in a raid. We know who we’re looking for. And that’s who the agents are out there seeking,” he stated.
Homan wasn’t finished. He closed with a brutal truth that Democrats don’t want the American people to hear.
“If you’re in the country legally, you shouldn’t fear ICE. But what you should fear is the criminal aliens walking the communities in sanctuary cities,” he concluded.
And that’s exactly what the Left is trying to cover up — not protecting American families, but shielding illegal immigrants, even those with violent pasts.
Homan is doing what the Biden administration refuses to do — uphold the law, protect our borders, and prioritize American safety over political correctness.
And no activist judge is going to stop him from doing it.
