The prosecution, led by Manhattan District Attorney Alvin Bragg, elevated misdemeanor bookkeeping charges into 34 felony counts by invoking COVID-era statutes—an approach that many legal experts view as unprecedented and legally dubious. The case accuses Trump of falsifying business records to cover up another alleged crime, yet the nature of this supposed additional crime remains unidentified. Jurors were instructed by Judge Merchan that they didn’t need to agree on what the secondary crime even was.

Gregg Jarrett didn’t mince words in his critique. “He was found guilty by a biased jury of crimes that don’t even exist under the law. He was all but framed by a politically driven DA who worked in concert with a hostile judge who was required to recuse himself but refused to do it. So this turned out to be a sham trial based on a convoluted, incoherent legal theory,” he stated. Jarrett also predicted the conviction would ultimately be overturned on appeal.

Veteran attorney Alan Dershowitz echoed Jarrett’s sentiments, likening the case to a Soviet-style show trial. “This is the worst instance of Stalinism in my 60-year career,” Dershowitz declared. “Stalin was told, ‘Show me the man and I’ll find you the crime.’ So Letitia James, the Democratic attorney general, and Alvin Bragg, the Democratic DA, tried to find a crime to convict Trump of, but they couldn’t.”

According to Dershowitz, the prosecution’s inability to pinpoint a crime led to the charges being “made up out of whole cloth.” He added, “If they can make up a case against Donald Trump, they can make it up against you too.”

Dershowitz speculated that the sudden decision to sentence Trump may be an attempt to limit his ability to appeal. “One way of avoiding him getting an appeal was not sentencing him. Now they’re going to sentence him,” Dershowitz said, suggesting that even a gubernatorial pardon would leave Trump with the stigma of a conviction.

The veteran attorney also outlined the numerous legal flaws in the case, including prosecutorial overreach, immunity issues, and judicial errors. “They’re looking at every possible way of avoiding an appellate reversal because any decent appellate court, any decent appellate court, will reverse this conviction for a dozen different reasons,” Dershowitz explained.

Both Dershowitz and Jarrett have called on Americans to recognize what they view as a blatant abuse of power. “This sham trial was rife with reversible errors by the judge, and it will eventually get overturned,” Jarrett concluded.

As Trump prepares to take the oath of office for his second term, this case has become a flashpoint in the battle over judicial integrity, political weaponization, and the rule of law in America. Critics argue that the timing and nature of the charges send a chilling message: no one, not even a president, is safe from politically motivated prosecutions.
