Court documents obtained by FOX4 Kansas City confirm the defense’s astonishing argument:
“The defense filing says McIntire is undergoing treatment for depression and is receiving gender affirming care that began in March of this year — and that care would likely be interrupted or terminated in federal custody.”
Incredibly, the court accepted the defense’s plea, claiming McIntire’s “transition” process was so critical that he couldn’t remain in detention — despite being charged with a violent attack involving firebombs.
Adding insult to injury, McIntire’s attorneys pointed to his clean criminal record and “strong community ties” in Kansas City to argue he posed no flight risk. Never mind that he was actually arrested over 1,000 miles away — in Boston!
“According to federal court documents, McIntire’s attorney argued he should be released, citing several ‘serious and ongoing’ medical needs and treatments that McIntire’s attorney believed could not or would not be provided while in federal detention.”
Under Judge Hedges’ order, McIntire’s movements are now limited — but only to the Western District of Missouri and two Kansas counties: Wyandotte and Johnson. In a just America, the only place this accused arsonist should be traveling is between a prison cell and a courtroom.
The alleged attack itself was no small matter. Court documents reviewed by KSHB show McIntire struck late at night on March 17, targeting a Tesla dealership located at 10111 State Line Road.
Armed with homemade Molotov cocktails — vinegar bottles filled with gasoline and dish towels — McIntire allegedly caused significant damage to two Cybertrucks and two charging stations. Although one explosive failed to ignite, the destruction was still severe.
Federal prosecutors have charged McIntire with malicious destruction of property and unlawful possession of an unregistered firearm. If convicted, he could face serious prison time — that is, if he doesn’t receive another sweetheart deal along the way.

His next court appearance is scheduled for Thursday, May 1, at 1 p.m. at the United States Federal Courthouse in Kansas City, Missouri.
This disgraceful decision sends a chilling message: left-wing extremists can commit dangerous, violent acts and still find sympathy in today’s broken court system — so long as they check the right political boxes.
When violent crime is excused under the guise of “gender-affirming care,” it’s clear the American justice system is spiraling into chaos. Law-abiding citizens deserve far better than judges who prioritize woke ideology over public safety.
