In a case raising serious questions about parental rights, religious liberty, and government overreach, a Massachusetts couple is now facing kidnapping charges after allegedly fleeing the state with their five children following a conflict with child welfare authorities.
Isael Rivera, 31, and Ruth Encarnacion, 30, were arrested in early March in Fitchburg, Massachusetts, after a multi-state search that ended in Texas. The pair stands accused of taking their children across state lines to avoid intervention by the Massachusetts Department of Children and Families (DCF).

According to officials, the couple vanished from Massachusetts just as DCF was preparing to remove the children from their home on February 27. Police and social workers launched a search days later, resulting in the discovery of the family weeks afterward in Whitney, Texas.
Rivera is the biological father of four of the five children. He was arraigned last week in Fitchburg District Court, where a not-guilty plea was entered on his behalf. He remains behind bars without bail. Meanwhile, Encarnacion, the children’s mother, faces five counts of kidnapping a minor by a relative. Her arraignment is scheduled for this week. She, too, has entered a not-guilty plea.
