Under federal sovereignty, border security is an essential national security matter. The southern border is a primary point of entry for drug traffickers, according to the Department of Homeland Security. Therefore, state governors still have an obligation to battle narcotics within their states when federal measures to maintain national security are insufficient.

The governor’s border strategy has drawn criticism because they believe it may intensify relations with Mexico and have an effect on foreign policy. Proponents contend that Mexico ought to exclude illegal immigrants at its southern border because the majority of them are not native to the country. Many conservatives wonder why the United States should bear the financial burden of Mexico’s inability to stop illegal immigration coming within its borders.

Less people would enter the country illegally without Biden’s incentives, such a route to citizenship, which would lessen the need for border fortification.

Furthermore, opponents contend that the Posse Comitatus Act (PCA), which is outlined in Title 18, Section 1385 of the US Code, is violated by Governor Abbott’s sending of the National Guard to the border. The Act effectively forbids the US Army and Air Force from serving as domestic police forces by forbidding them from being used to “execute the laws” within the country. Supporters of his National Guard deployment, however, argue that since the National Guard functions as state rather than federal troops when summoned to state service, the PCA should not apply to National Guard units activated by state governors.

Theoretically, President Biden might push for federalization under White House authority or mobilize Texas Guard forces and send them abroad. But since the governor’s approval is usually required, it seems doubtful that Biden would contest Governor Abbott’s authority unless he were accused of a significant crime. Sustained discussions may result in a Supreme Court case, and as Texas pays for the activation of the National Guard, money will ultimately become an issue.
