The Associated Press reported that Garcia’s lawyers claimed the Trump administration might actually carry through with removing him, citing what they called “contradictory statements” about the government’s intentions.

In a filing to the court, his attorneys declared:

“we cannot put any faith in any representation made on this issue” by the Justice Department.

And they freely admitted:

“The irony of this request is not lost on anyone.”

That’s right: Defense lawyers are actively begging a judge to keep their own client locked up instead of letting him go — all because they fear he’ll be deported for good under Trump’s policies.

Obama-Appointed Judge Wants Garcia Freed

The saga began when U.S. District Judge Waverly Crenshaw, an appointee of President Obama, determined Garcia should not remain detained while he awaits trial on federal human smuggling charges.

Judge Holmes became the second federal judge to echo that stance, ruling that Garcia didn’t need to be held over his criminal charges.

However, Garcia hasn’t walked free yet. Immigration and Customs Enforcement (ICE) continues to keep him behind bars pending deportation action.

The Department of Justice announced last Thursday that deportation proceedings are on the table after the federal court ordered Garcia’s release. The DOJ previously told the court that Garcia would be sent to a “third country” rather than El Salvador after he’s let out of the Tennessee jail.

Prosecutors haven’t said when that might happen, only stating that deportation isn’t “imminent.”

Facing Smuggling Charges That Could Land Him Decades Behind Bars

Earlier this month, Kilmar Abrego Garcia appeared in a Nashville court wearing a red prison jumpsuit. He entered a not-guilty plea on charges connected to human smuggling.

A federal grand jury indicted him for “transporting undocumented migrants within the United States,” slapping him with one count of conspiracy and another for unlawful transportation of migrants.

According to prosecutors, Garcia allegedly worked with co-conspirators spanning El Salvador, Guatemala, Mexico, and the U.S. from 2016 through 2025 to move migrants across American soil illegally.

“If convicted at trial, the defendant faces a maximum punishment of 10 years’ imprisonment for ‘each alien’ he transported,” the government revealed.

Given the potential number of migrants involved, Garcia could be staring at decades in federal prison.

Tied to Murder and Brutal Violence

But Garcia’s alleged crimes extend far beyond smuggling.

Prosecutors say one of his associates told federal agents that Garcia participated in the murder of a rival gang member’s mother.

Adding to the concern, Fox News recently aired bodycam footage from 2022 showing Garcia caught in the middle of a human smuggling operation in Tennessee.

Incredibly, Biden-era law enforcement agencies repeatedly failed to act decisively. As Fox reported, when Garcia was apprehended:

  • The FBI under Biden allegedly advised simply letting him go.
  • ICE reportedly didn’t even bother to show up.

Such revelations have infuriated critics who say the Biden administration’s weak enforcement has emboldened gangs like MS-13 to operate unchecked.

Trump’s Crackdown Has Defense Lawyers Running Scared

Under President Trump, MS-13 and similar gangs have been labeled Foreign Terrorist Organizations, granting law enforcement broader powers to dismantle their networks.

But judges appointed during Democratic administrations appear determined to throw roadblocks in the way of Trump’s tougher stance.

The fact that Garcia’s own attorneys would rather keep him jailed than risk deportation shows how seriously they take Trump’s return to stricter immigration enforcement:

“The irony of this request is not lost on anyone.”

Defense lawyers clearly know that under Trump, deportation actually means deportation — not just releasing suspects with a promise to appear in court years down the road.

Americans Left to Deal With the Consequences

This case has become a symbol of what many conservatives call a broken justice system.

Despite Garcia’s alleged ties to violent crimes and human trafficking, multiple federal judges have moved to set him free pending trial.

Only the bizarre move by Garcia’s own lawyers to keep him locked up is preventing him from walking out of jail right now.
