Before landing back in the United States through a series of legal maneuvers pushed by left-wing attorneys, Garcia was living illegally in Maryland. Immigration officials eventually deported him earlier this year, sending him back to El Salvador, where he was held inside the notorious CECOT prison — a facility reserved for some of the most violent criminals in the region. But sympathetic judges demanded he be returned to the United States, and incredibly, the system complied.

Even worse, this isn’t the first time Garcia has attempted to escape deportation. An immigration judge had previously ordered him removed from the country but barred his return to El Salvador. The Trump administration, facing resistance from activist lawyers and advocacy groups, explored options to deport him elsewhere — even considering relocation to Africa.

Garcia immediately went on the offensive, launching yet another legal challenge in an effort to stay inside the United States. Over the summer, his defense tried to halt his removal, using emotional arguments to sway the courts. He claimed, “I fear persecution in Uganda on account of my race, nationality, political opinion, and membership in a particular social group. I also fear torture by or at the acquiescence of a public official in that country.”

Meanwhile, Judge Xinis is handling a civil habeas corpus case filed on Garcia’s behalf by his wife — a case that has received more attention from the legal system than most law-abiding Americans could ever dream of.

But there’s an even more troubling layer: Garcia isn’t just entangled in immigration disputes. He is currently facing federal criminal charges in Tennessee after a grand jury indicted him on human trafficking offenses. Over the summer, he was charged with “transporting undocumented migrants within the United States,” a serious federal crime that would normally result in detention — not release.

In Tennessee, prosecutors have laid out two counts against him: one for conspiracy to transport illegal aliens and another for the unlawful transportation of undocumented migrants. Despite this, Judge Xinis’ ruling effectively places a federally indicted MS-13 member back onto American streets.

Once again, the justice system appears more invested in protecting criminals than protecting American citizens. And with decisions like this, critics warn it may only be a matter of time before the consequences hit home.
