In a bold move, Representative Anna Paulina Luna (R-FL) has taken a firm stance on the issue of congressional oversight and accountability, specifically targeting Attorney General Merrick Garland. During a recent press conference, Rep. Luna expressed her concerns over what she perceives as a double standard within the justice system, particularly highlighting Garland’s non-compliance with a congressional subpoena.
The conflict stems from a February incident where the Oversight Committee, along with the House Judiciary, issued a subpoena to AG Garland. According to Rep. Luna, there was no response from Garland, prompting the committee to refer him for criminal contempt shortly thereafter. “We are here today because of the double standard that exists within the justice system,” Luna declared, underscoring the gravity of the situation.

Rep. Luna emphasized the historical and legal foundations of Congress’s power to enforce its subpoenas through inherent contempt, a power first exercised in 1795 and affirmed by the Supreme Court in the 1927 McGrain vs. Doherty case. “Inherent contempt is clearly within our Article One authority, and Congress does have the power to investigate all legislative powers,” she stated, reinforcing the legitimacy of congressional inquiries.
