A recent ruling by the Supreme Court of the United States has temporarily blocked former President Donald Trump from using expansive emergency powers to impose sweeping global tariffs—but legal analysts quietly acknowledge the decision may not be the knockout blow critics were hoping for.
The Court determined that Trump could not rely on the International Emergency Economic Powers Act (IEEPA) as a blanket authority for his aggressive tariff agenda. However, even as legacy media celebrated the decision, several legal experts conceded that alternative laws remain available that could still allow Trump to move forward—albeit with more restrictions.
That reality was openly discussed by Elliot Williams, a CNN legal analyst and former Obama Justice Department official, during an appearance on The Bulwark’s podcast Illegal News. Williams admitted that while the ruling clipped Trump’s wings under IEEPA, it did not ground him entirely.
“Justice Kavanaugh did sort of lay out a bit of a roadmap for saying that, yes, there are avenues for the president to get some tariffs,” Williams said during the interview.
