The contentious battle captured national attention as it unfolded, highlighting the tension between public health directives and individual rights.
Back in 2020, Smith and his business partner, Frank Trumbetti, defied state orders by keeping Atilis Gym open, resulting in a slew of legal challenges. They faced over 80 summonses, accused of defying the governor’s mandates, operating without a proper business license, and being a public nuisance, among other charges. These charges, as highlighted by their attorney John McCann, could have led to six months of jail time for the gym owners.

The financial repercussions were severe, with the gym racking up fines exceeding $165,000 for flouting various emergency health mandates set by Governor Murphy and Judith Persichilli, the state Health Commissioner. Despite the municipal charges being recently dropped, the battle over the hefty state-imposed fines continues, with efforts underway to mitigate these penalties.
