Just In: Trump’s Move Could Stall Smith Trial for Months!

The former president Donald Trump’s lawyers are requesting millions of pages of classified documents related to the Capitol riots on January 6, 2021. This action could postpone the federal trial against him for months, possibly until after the next election.

The president’s legal team has filed a motion to obtain access to classified documents that include details on his schedule as president, election tabulation data, and whether or not undercover officers were present during the riots. Judge Tanya Chutkan will now have to consider this motion. In Trump’s separate federal case, where it was claimed that he had improperly taken and stored classified documents after leaving the White House, a similar motion was granted.

“All documents regarding informants, cooperators, undercover agents, representatives, or anyone acting in a similar capacity” who were “at or within 5 miles of the United States Capitol on January 6, 2021” are among the 57 groups of documents listed by defense attorneys Todd Blanche and John Lauro in their filing.

In addition, they are requesting “all documents relating to investigations relating to fraud, interference (including but not limited to foreign interference), or irregularities during the 2020 election, including details of Dominion Voting Systems and its voting-system products” as well as “the election security and integrity risks arising from the cyberattack and data breach relating to SolarWinds, Microsoft, and VMWare in or about 2020.”

The documents that pertain to President Trump’s daily schedule from October 1, 2020, to January 20, 2021, including itinerary plans, scheduling materials, and summaries of his activities—including his “daily diary”—are also sought after by the Trump team.

“All audits of election results, vote tabulation, vote submission, or related election activities performed by state governments named in the Indictment” are what they are requesting in relation to the actual election.

The latest defense motion, according to prosecutors who have accused President Trump of tampering with the 2020 election results, is an additional effort to delay the trial’s start date past the elections in November 2024. According to Newsweek, if Trump were to win the presidency again, he might ask the Supreme Court to dismiss the case on the grounds that it conflicts with his schedule.

As president, Trump would have “a host of potential strategies available,” according to Paul Golden, a partner at the New York City law firm Coffey Modica. One such strategy would be this one.

Trump’s legal team, meanwhile, is looking for information regarding “broad Russian and Iranian campaigns” to erode faith in the US electoral system because they think foreign actors may have presented a bigger risk to the outcome of the 2020 election. Furthermore, records demonstrating that China, Venezuela, and Cuba “owned, directed, or controlled election infrastructure used in the 2020 federal elections” are sought after.
