Judge Indicates Prince Harry’s Immigration Files May Be Released
The legal battle over these records has been playing out in federal court. D.C. District Court Judge Carl J. Nichols has now signaled that he is likely to rule in favor of transparency, stating that he must “make public everything that can be made public.”
However, before any documents are released, the Department of Homeland Security (DHS) will have the opportunity to redact certain sensitive portions.
Previously, Nichols sided with DHS, ruling that the public had no compelling interest in Prince Harry’s immigration history. That ruling was based on sworn statements from the department rather than an independent review of the actual records. Now, the judge has acknowledged the Heritage Foundation’s argument that these statements alone are insufficient.
“We can talk about how one goes about unringing that bell,” Nichols remarked, referring to the process of potentially reversing previous decisions. “At a minimum, we’d have to go through that process.”
What Could Be Revealed?
The Heritage Foundation believes Prince Harry’s visa records could expose favoritism within the Biden administration. If Harry admitted to drug use on his application, he would have needed a waiver—documentation that DHS should possess.
Heritage attorney Samuel Dewey has cast doubt on whether the documents DHS intends to release will be meaningful. “I certainly think that some stuff can be disclosed and I don’t think it would necessarily just be a shell,” he stated.
Dewey suggested that there are only a few plausible explanations for Harry’s immigration status. “If he came in, got a waiver, said, ‘Yes, I did all these drugs. Here’s the 10-page attachment to my form where I checked ‘yes,’ detailing all my directives, got a waiver’—those records would be in DHS. There would be DHS records adjudicating a waiver,” he explained.

Alternatively, Dewey speculated that Harry could have received a diplomatic visa from the State Department, or “they just let him in . . . No different than if I walked across the Rio Grande, paroled you into the country, said, ‘You’re a gotaway. Go!’”

The upcoming decision could have serious consequences for Prince Harry. If it is revealed that he was granted special treatment, it could fuel accusations of political favoritism. If he misrepresented his drug history, it could raise legal issues regarding his residency in the U.S.
