A federal judge delivered a blistering rebuke to U.S. Attorney Alina Habba this week, sharply criticizing her decision to criminally charge Newark Mayor Ras Baraka — only to abruptly drop the case less than a week later. The stunning turn of events has sparked a political firestorm, raising serious questions about the motives and competence behind the prosecution.

Earlier this month, Mayor Baraka was taken into custody after storming into the Delaney Hall ICE detention facility in what officials described as an uninvited and disorderly breach. Baraka, a Democrat and current candidate for governor of New Jersey, was arrested for criminal trespass following the incident, which unfolded during a chaotic confrontation involving ICE agents and several Democratic lawmakers.
Then, without much warning, the case took a dramatic U-turn.
On Monday night, U.S. Attorney Alina Habba announced that her office was dropping the misdemeanor trespass charge against Baraka. In a statement posted to X, Habba said, “After extensive consideration, we have agreed to dismiss Mayor Baraka’s misdemeanor charge or trespass.”
