Habba’s statement didn’t end there. She added a surprising invitation for the embattled mayor: “In the spirit of public interest, I have invited the mayor to tour Delaney Hall. The government has nothing to hide at this facility, and I will personally accompany the mayor so he can see that firsthand.”
But the controversy didn’t stop with the mayor. Habba also revealed that her office was charging Democrat Congresswoman LaMonica McIver for allegedly assaulting ICE agents during the same clash at the detention facility.
The rapid escalation and retreat from the prosecution of Baraka didn’t sit well with U.S. Magistrate Judge André Espinosa, who addressed the matter in a virtual hearing on Wednesday. The judge, who had previously cautioned Habba against public commentary on the case, didn’t hold back in his criticism.
Calling the arrest and its sudden dismissal a “worrisome misstep,” Espinosa said the incident raised red flags about the integrity of the justice process. He described the reversal as an “embarrassing retraction” and warned that such hasty actions risk undermining public confidence in the legal system.
“The hasty arrest and swift dismissal of a trespassing charge against Mayor Ras Baraka suggests a worrisome misstep,” Judge Espinosa declared during the hearing.
He reminded the courtroom that an arrest is not a casual or political tool — it’s a serious act with real consequences. “An arrest is a ‘severe’ step, not part of an investigation,” he said, adding that prosecutors should never operate based on political winds or public pressure.
“Your office must operate with a higher standard than that,” Espinosa scolded, sending a clear message to Habba and her team.
